Lawyer Proposes Legal "Male Abortion"

DAYTON, Ohio (CWNews.com) - An article in the current issue of the Journal of Law and Policy, made public on Monday, proposes that unwed fathers should have the right to "abort" their responsibilities to their unborn children as a natural extension of a woman's legal right to abortion.

Whereas the woman is free to choose the extent of her responsibility toward the child via such avenues as adoption, abortion, or keeping the child, the unwed father is denied such freedom of choice because his options are wholly dependent on the woman's decision, wrote South Carolina lawyer Melanie McCulley. Since the father does not have a right to compel an abortion, she added, he should have the right to place himself in the same legal position as if the woman, who carries the child to term, had actually chosen abortion.

McCulley also proposed that new legislation enumerate the grounds under which the father can "abort" his legal responsibilities, including the woman's fraud and misrepresentation, a binding contract between the unwed parents, the unwed father's offer of payment for abortion, his guaranteed consent to adoption, and his full disclosure prior to intimacy of his intent to refuse responsibility for any resulting child.

Critics of the "male abortion" contended it would allow an unwed father to avoid financial responsibility for a living child and encourages real abortions. Court decisions after the US Supreme Court's Roe v. Wade decision legalizing abortion have held that protecting the unwed father's freedom of choice is not in the child's best interests and creates a financial burden on the State.

Let's change a single word of the sentence above:

"Court decisions after the US Supreme Court's Roe v. Wade decision legalizing abortion have held that protecting the unwed [b]mother's[/b] freedom of choice is not in the child's best interests and creates a financial burden on the State."

Seriously, this "male abortion" idea is just another logical consequence of the Culture of Death philosophy.

but, in effect, this is what the "women's movement" has created. if women don't respect their bodies, how are men to respect women's bodies? we've seen that with pornography.

Although I believe the effort won't have much success, the effort itself is disheartening.

Not to sound cruel, but if women can choose to have an abortion or not, then why not men? I can see the pro-abortion women going nuts over this, how hypocritical. That'll teach them.

I think that the child should have the option of being aborted too. The law should require all children be allowed to live until a legitimate age of reason so that they can decide whether or not they'd like to be aborted or continue living.

I think it is unfortunate, but perhaps, in a way, it would disenchant so-called "feminists" shouting the pro-abortion agenda, by emphasizing the father's rights in a pregnancy.
Not that I am for such a thing, but if women are going to be disobedient and irresponsible to the children's fathers, I see no reason why men should have to pay for the mother's problems.

Well, if a man tells you to have an abortion I highly doubt that he will support the child financially any way since he doesn't want the child.

I agree with Dust. I think we should let the child decide. I am sure that it would clear up many misunderstandings...

Although you guys are not for this at all, I have to disagree with you. This law will only cause more and more trouble. I know a girl from college who became pregnant. Originally she was going to have an abortion. Her boyfriend agreed. Then later, after talking to family members including her mom she decided to keep the child. The father was not all that happy. What then? If this law were in place the child may not be here.

It is not only the women's fault for having a baby out of wedlock. It is the father's as well. They should own up the responsiblity with the mother and raise the child they concieved together.

This whole thing is just illustrating more and more clearly that the culture of death in which we live is not solid rock

this is sickening... this culture of death has gotten way out of hand...

if people actually researched it and looked at the baby in the mother's womb... they will see that a baby is in there...

my youth minister said to argue abortion like this

a. "it" is a baby and we know it
b. "it" is a baby and we don't know it
c. "it" is not a baby and we know it
d. "it" is not a baby and we don't know it

a. would mean that "it" is a baby and therefore is alive
b. would mean that we cant kill the baby b/c it is a baby until u can prove that "it" isnt
d. is the same as b.
so therefore the only possible answer that will say that abortion is okay is c. and therefore the other person would have to prove that the baby isnt alive... and they cant do that b/c it is alive and it can be proven that the baby is alive

i hope that made sense to everyone
