Everyone who willfully communicates hate statements is guilty. But, Sec 319(3)(b) or © look like good defenses on his part. 3rd the intent element in hate speech is essential. It has to be intended to cause fear or intimidation. Now, I think the conversion (civil tort for stealing) might be a better route. Of course I think you'd have to have his local Church sue him - you couldn't do it (since it was not your property). Of course this may only serve his purpose - are we going to claim that he has stolen a piece of property? The Body of Christ? I dunno... I'll keep thinking.
