I could've sworn there was a Second Amendment, part of a Bill of Rights thing. Granted it's been trampled on for the past seven years or so in some ways, but that Bill of Rights still exists. A President can not overturn these rights without a constitutional Amendment, which is nigh impossible to pass, or by passing a law which can gently nudge at the edges of the Amendments in the Bill of Rights such as the Patriot Act or the recently expired Assault Weapons Ban, which also requires Congressional aid.
