I know its really sad. He's not in college anymore not matter how much he wants to try to live like one again. He is a professional now, one that is in the public eye always. If he does not be careful he could ruin what he has worked so hard on building.

i am shocked
I don't think smoking pot is a good idea, but I don't think it's a reason to end his career. It has nothing to do with his ability to swim, it's not like he's been caught taking steroids. It never ceases to amaze me that with all the important issues going on in the world, the news spends so much time on stupid celebrity blunders. -Katie
So if you're in a country where it's legal, do you get to use it?
I don't know where it's completely legal. It's decriminalized under a certain amount in Canada, but it's not like a free pass to smoke pot all day and night. If pot were legal, I'd probably be smokin' it lol -Katie

Nope...this isn't about legality, the issue is that Phelps used a drug that is banned by the IOC. If they want to take a literal interpretation of that rule (which they very likely might) and if they want to come down hard on Phelps (again, good chance that happens) Phelps could miss the next Olympics.

Being in college is not an excuse to smoke marijuana.
Its legal in Amsterdam.

But I don't think its very clear that its really him in the pic. Could be wrong.
Oh, right, how could I forget Amsterdam! Maybe he's smoking fruited tobacco  I smoked some of that out of a Turkish Water Pipe in Madrid. Technically a picture can't prove what he was smoking. -Katie

Well, there you go.

What an idiot.

The direct 'letter of the law' guy in me wants to say that they could not impose sanctions on him due to the photograph. The photograph shows him with drug paraphernalia, but not with drugs. They would need a test of some kind to show definitively that he was using drugs. And unless he is currently in competition, I don't see how the IOC could force such a test.

Phelp's also acknowledged it is him in the photo, but does not admit to smoking anything.
Marijuana is viewed differently from performance-enhancing drugs, according to David Howman, executive director of the World Anti-Doping Agency. An athlete is subject to WADA sanctions only for a positive test that occurs during competition periods.

“We don’t have any jurisdiction,” Howman said. “It’s not banned out of competition. It’s only if you test positive in competition.”
...
He said U.S. officials and swimming’s world organization, could punish Phelps—perhaps under code of conduct rules—if there is “sufficient evidence to indicate possession, supply or distribution.”
