The store btw, was a total loss because of this nine year old, and put seven people out of work in addition to destroying everything within. Fortunately at least, no one was hurt. My kids put it back on the shelf. Now, they might be reluctant, or say "Maybe another day?" with hope shimmering in their little blue eyes, and they might even knock a few things over as they put it back and leave things a little messy for the poor guy who has to straighten out the shelves. When your kid accidentally throws a baseball through a window, it is negligence, and the home owner can only sue the kid. If a child intentionally throws the baseball, it isn't negligence, it is intentional, and then the homeowner is allowed to sue both the kid and the parents. Everyone out of work can file for lost wages, the city can sue for the cost of putting out the fire, and the store owners for the loss of the store and merchandise (less the amount their insurance pays, but then the insurance company can sue for that amount). I live here in Chattanooga, and my wife and I were taking the kids to walk around at the mall nearby (it was raining outside) and got caught in all the traffic mess created by the fire (we were driving on Hixson Pike). I dropped him off at the neighbors where he sat in the corner in time-out, while I went back with my other kids to finish the shopping and get ice cream. I almost didn't believe this story but I found it somewhere else and they are charging the kid. No one was hurt in the Tuesday afternoon fire at the store on Hixson Pike. Fire investigators have charged the boy with aggravated arson and reckless endangerment. Fire Department spokesman Bruce Garner said in a statement that the boy told firefighters he was mad at his mother, so he walked to rear of the store and set rolls of bathroom tissue on fire. Store Manager Tammy Laney said she tried unsuccessfully to put the flames out herself. She then got everyone out and called 911. The Dollar General Store and its contents are a total loss.
