If Not Adultery, Then What?

It would be so much simpler if everyone just becomes Catholic and gets married in the church, then stays that way .... ahh, I'm such an idealist.
So if a non-practicing "catholic" [baptised but had never attended church or been raised catholic, in fact was raised anti-catholic] marries a non-practicing protestant in a civil ceremony, they are civilly married but not sacramentally married??
If they get divorced and the protestant wants to marry a diffeernt catholic, does he have to get an annullment from the first marriage?

The marriage laws are very confusing!
Whose "he" the Protestant or the Catholic? And now you get to experience the joys we priests experience when we have to do weddings...there is no easy wedding these days :)

He is a baptised protestant who has never been to church.
She is a baptised catholic who was raised anti-catholic fundie.
They were married before a JP.

They divorce and he wants to marry a catholic.
How do I explain this to them?
